whether Government intends to constitute the Seventh Pay Commission

The early constitution of Seventh Pay Commission is major demand of BRMS & ALL MAJOR UNIONS IN RAILWAYS
The similar matter is also pending in current 226th session of Rajya Sabha. The following questions on setting up of Seventh Pay Commission from Shri Balwinder Singh, Member of Parliament was scheduled to answer from Finance Ministry on 9th August is still pending:-

(a) whether Government intends to constitute the Seventh Pay Commission for the Central Government employees;
(b) if so, by when;
(c) whether the Thirteenth Finance Commission has also recommended for an increase in pay of Central Government employees from the future date; and
(d) if so, the details thereof?

Final settlement money & calculation of Pension

THIS IS THE WAY   -   YOU MAY CALCULATE YOUR PENSION
Basic Pension
     Basic Pension is calculated as the last month emoluments or average of last 10 month emoluments which is higher. Normally higher of this will be last month emoluments unless the employees Pay was reduced in last months due to a punishment etc.
Emoluments
     For Doctors - Basic Pay(Pay + GP)  plus NPA(Non Practicing Allowance)
     For other employees - Basic Pay(Pay + GP)
     For Railway Running staff (Loco Pilots, Asst Loco Pilot, Guards) 55% of Basic Pay is added to the basic pay for all pension calculations.

Imagining that the Railway servant in question didn’t get a pay reduction in the last 10 months,
 
  His emoluments will be equal to Last Basic Pay(Pay + GP) = Rs. 25000
  His Basic Pension  ( 50% of emoluments  ) = Rs. 12500/-
Now he has two options:
Option 1 : He doesn’t opt for commutation.
  If the employee doesn’t opt for Commutation he has get the Basic Pension Rs. 12500 plus applicable DR(Dearness Relief) on this(65% from 1.1.2012)
Option 2 : He opt for commutation
  Maximum 40% of the Basic Pension can be commuted.
  Commutation amount = Age factor x 12 x (40% of Basic Pension) = 8.194 x 12 x (40% of 12500) = Rs. 4,91,640
  (No DA/DR  is paid on this and hence DR will be paid on the full Pension amount monthly)
  Now for the first 15 years the employee get the remaining amount pension  ie, 60% of 12500 = Rs.7500 (plus DR calculated on full pension or Rs. 12500).
  After  the expiry of 15 years the employee gets full pension as that  in Option 1
Gratuity
  Gratuity is calculated as half month emoluments for every completed year of service subject to a maximum of 33 years.
Emoluments for purpose of Gratuity

  For other employees :(Pay + GP) + DA
  For Running Staff : (Pay + GP + 55% as Pay element of Running staff) + DA
  Maximum of amount of Gratuity will be 10 Lakhs.
 
In the illustration above,
  Service is 35 years, but maximum is 33 yrs.
  Emoluments (for this purpose includes DA also) = 20400 + 4600 + (65% of 25000) =41250
  Hence Gratuity = 16 ½ * 41250 = Rs.6,80,625
Leave encashment
  Leave encashment upto  300 days (both LAP and LHAP combined) is permitted.
 The above employee has 250 LAP and 198 LHAP.
  So in his case 250 LAP and 50 LHAP (total 300) will be encashed.
  Encashed amount of LAP (for 250 LAP) = (Pay + GP + DA applicable) / 30 * LAP at credit = (20400 + 4600 + 16250) /30 x 250 = Rs. 3,43,750 /-
  Encashed amount of LHAP (for 50 LHAP) = (Pay + GP DA applicable) /2/ 30 * LHAP at credit (subj to overall limit of 300)  = (20400 + 4600 + 16250) /2/ 30 x 50 = Rs. 34,375 /-
  Total amount of leave encashment = Rs. 2,29,166 /-
Provident Fund
  Balance at the credit of employee’s SRPF is paid at the time of his retirement along with interest accrued.
Final settlement money for the above employee
  Pension commuted = Rs. 4,91,640
  Gratuity = Rs.6,80,625
  Leave encashment = Rs. 2,29,166
  PF Balance = Rs.1,02,345
  Total settlement amount = Rs. 15,03,776 /-

Government. Right sizing /down sizing policy

CENSUS OF CENTRAL GOVERNMENT EMPLOYEES (As on 31st MARCH, 2009)


As per the result of Census Enquiries, the total regular employment under Central Government as on 31st March, 2009 was 30.99 lakh as against 31.12 lakh on 31st March, 2008.
The employment has, thus, recorded a decline of 0.42% in 2009 over 2008. (2). Employment in Ministry of Railways was the highest (44.74%) followed by the Ministry of Home Affairs (24.14%), Defence civilian (11.77%), Communications & IT (7.06%) and Finance (3.49%). Other Ministries/Departments collectively shared the rest of 9% of the total Central Government regular employment. (3). Out of 30.99 lakh regular employees, 3.11 lakh were women.
The proportion of women in the total employment is almost static, around 10% in the year 2009, 2008 and 2006
EMPLOYMENT UNDER CENTRAL GOVERNMENT
The total number of regular civilian employees under Central Government establishments as on 31st March, 2009 was 30.99 lakh. The Table-1 shows overall comparative change noticed in the level of Central Government employment (regular) as on 31st of March, 2008 and 2009.

The total employment under Central Government as on 31st March, 2009 as per Census has gone down by 0.13 lakh over 31st March, 2008. This decrease may be attributed to various recruitment policies of the Government. Right sizing /down sizing policy has been a major contributory factor for this declining trend.

EMPLOYMENT UNDER VARIOUS MINISTRIES
2.2 The distribution of regular employees in major Ministries is given in Table-2:

The Ministry of Railways has a major share (44.74%) of the total regular Central Government employees followed by Ministries of Home Affairs (24.14%), Defence (civilian) (11.77%), Communications & IT (7.06%) and Finance (3.49%). These five Ministries taken together accounted for 91% of the total Central Government employment. The residual employment (about 9%) was shared by all the remaining Ministries/Departments of the Central Government.

WOMEN EMPLOYMENT UNDER CENTRAL GOVERNMENT
2.3 Women employment under Central Government has been estimated to the tune of 3.11 lakh, which is 10.04 percent of the total regular Central Government employment. Women employees together with their proportion in the total estimated women employment in the major employing Ministries for the year 2009 is shown in Table-3:

It may be observed from Table-3 that participation of women was highest in Ministry of Communications & IT(15.78%) whereas participation of women in Ministry of Railways is quite low (6.43%) as compared to overall women participation in Central Government employment. Ministry of Defence (civilian) has fair share of women employment i.e. 10.79%. The participation of women shared by rest of the Ministries/Departments was of the order of 13.11%.

India’s Stand on ILO Conventions Briefed to the Parliamentary Consultative Committee of M/O Labour & Employment

The Consultative Committee members of the Ministry of Labour & Employment have urged the Government to ensure due patronage to the traditional skill while going for the ratification of Conventions adopted by the International Labour Organisation (IlO) on Labour issues, especially in the arena of Child Labour. The members have also called for expediting the cause of providing a minimum pension of Rs. 1000 per month to the EPF beneficiaries as well as to ensure proper registration of workers in the unorganized sectors particularly the construction workers. 
The meeting of Consultative Committee of Labour & Employment Ministry which held yesterday evening was convened for providing in insight to the members of the various conventions of ILO as ratified by the Government of India on time to time. Speaking on the occasion, Union Labour & Employment Minister Shri Mallikarjun Kharge who chaired the meeting, said India, a Founding Member of the ILO, has been a permanent member of the ILO Governing Body since 1922. ILO has now expanded its membership to 185 nations. The first ILO Office in India started in 1928. The decades of productive partnership between the ILO and its constituents has mutual trust and respect as underlying principles and is grounded in building sustained institutional capacities and strengthening capacities of partners. It has a two-directional focus for socio-economic development: overall strategies and ground-level approaches. 

The Minister said the approach of India with regard to International Labour Standards has always been positive. The ILO instruments have provided guidelines and useful framework for the evolution of legislative and administrative measures for the protection and advancement of the interest of labour. It has always been the practice in India that we ratify a Convention when we are fully satisfied that our laws and practices are in conformity with the relevant ILO Convention. The ILO has so far adopted 189 Conventions and 201 Recommendations. Out of 189 ILO Conventions, India has so far ratified 43 Conventions which includes 4 (four) core or fundamental human rights Conventions. 
He said we have ratified 4 core conventions and 3 priority/governance conventions. The 4 core conventions ratified by us are Forced Labour Convention (No.29), Abolition of Forced Labour Convention (No.105), Equal Remuneration Convention (No.100) and Discrimination (Employment Occupation) Convention (No.111), and the 3 priority conventions ratified are Labour Inspection Convention (No.81), Employment Policy Convention (No.122) and Tripartite Consultations (International Labour Standards) (No.144). Even where for certain reasons where we may not be in a position to ratify a Convention, we have generally voted in favour of the Convention reserving its position as far as its future ratification is concerned. 
The journey of ILO over the last more than nine decades has been eventful and full of important milestones. However, the primary function of ILO is standard setting and their application. Many of the ILO Conventions are outdated and need to be revised as identified by Cartier Working Party. Even the core conventions have failed to achieve universal ratification due to lack of flexibility. Our concern is that ILO should undertake in-depth analysis to put in place a standards strategy which encourages steps like progressive ratification of a Convention. The choice of topics for future standard setting should be widened according to the requirements of all ILO member states having diverse socio-economic conditions. In the years to come, ILO must maintain its leadership in the subjects related to labour since it has the unique advantage of tripartite structure, transparency and the ability to obtain inputs from real economy, Shri Kharge added. 
Shri Kharge said the challenges being faced by the Member states on Ratification and promotion of fundamental and governance ILO Conventions are due to non-conformity with national laws and lack of technical assistance. He said India’s stand is that the process of ratification of these conventions should be a gradual one and adequate time should be given to the Member States for creating favourable conditions for ratification, taking into account the socio-economic realities of each Member state. The link-up of the four Governance Conventions to the Social Justice Declaration should be more of promotional in nature. We should adopt a more pragmatic and realistic approach for ratification and promotion of these conventions through creating awareness, building capacities of the constituents, advocacy, training and technical cooperation. 
A power point presentation on the preparedness and attention paid by the Government at the ILO meetings was also presented during the meeting. 
The meeting was attended by following MPs: S/Shri Gurudas Dasgupts, R.K.Singh Patel (SP), Ram Sunder Das (JDU), N.Peethambara (INC), Badri Ram Jakhar (INC) and Shri MangalaKisan (BJD). Secretary Labour & Employment Dr. M. Sarangi and senior Officials from the Ministry were present during the meeting.

BACKGROUND
1.  In India the Youth Hostel movement was initiated by the Youth Hostels Association of India in 1949. Till 1966 the Association had created a number of simple youth hostelling facilities by using University/College Hostels during vacation.
2.  The Government scheme for constructing Youth Hostels was embarked upon by the Ministry of Education in early sixties. With effect from 4th January 1985, the subject was transferred to the Department of Youth Affairs & Sports. At present, while 77 Youth Hostels have already been constructed across the country, 5 more Youth Hostels are under various stages of construction.
3.   On the advice of the Planning Commission, a Central Committee on Youth Hostels was constituted in February 1962. This Committee outlined a programme for constructing four model Youth Hostels in Delhi, Bombay, Madras and Kolkatta and 10 similar Youth Hostels at places of historic and cultural interest. Under the aegis of the Ministry of Education however the scheme could not be implemented for some years. In 1963, the Youth Hostels Association of India also embarked upon a project to construct a Youth Hostel in the Diplomatic Enclave in New Delhi but it started functioning from 1977 only. In 1966 the responsibility of establishing Youth Hostels was transferred to the Department of Tourism on the recommendation of a Working Group set up by the Planning Commission in October 1965. The Department of Tourism implemented the scheme of constructing 17 Youth Hostels.
YOUTH HOSTEL SCHEME 
4.  The construction of Youth Hostels is a joint venture of the Central and State Governments. As such, the State Government makes available to the Central Government a fully developed plot of land, free of cost, measuring 1.5 to 2 acres, for construction of a Youth Hostel, keeping in view the various considerations that decide its suitability. In case of State Capitals, big Cities and hilly areas a fully developed plot of land measuring 0.75 to 1 acre may be considered as acceptable for the construction of Youth Hostel building. The State Government gives the land on lease to the Central Government for a period of 99 years on a nominal rent of Rs. 1 per month. The Government of India constructs the  Youth Hostel and the completed building is leased to the State Government for a period of 99 years on a nominal rent of Rs. 1 per month. Lease deeds, both for land and the Hostel are executed by the parties. The land and the building are to be used as a Youth Hostel only and are not to be put to any other use.
5.   In case suitable vacant plots are not available, outright purchase of a suitable building with a spacious compound can be resorted to by the Government of India, without insisting on the size of the plot available. 
PROVISION OF FUNDS
6. The Central and State Governments share responsibility regarding provision of funds for starting the Hostel. A sum of 
Rs. 1.60 lakhs is paid by the Central Government for equipping the Hostel and a working capital of Rs. 50,000/- is paid to the Hostel by the State Government. This is periodically reviewed.
